TMT (Telecoms/Media/Technology)
TMT disputes are an increasingly important part of our commercial litigation offering.
Media cases in which members of Chambers have been involved include contractual claims in the broadcasting industry (film, television and radio), newsprint and disputes in the music industry. We have conducted internal inquiries alongside broadcasters, and have had involvement in the recent phone calls pricing inquiries. We have advised a major international recording artist on rights relating to release of free-to-air music, and also advised on data rights issues in the gaming industry. Individual members of Chambers have experience in domain name and internet related issues, some of which have been related to data protection.
We regularly undertake telecoms work within the ambit of regulatory, Public and EU/ Competition Law, and also have undertaken significant contractual disputes between mobile phone operators.
In the field of software contract cases we have long been regarded as one of the leading chambers for large scale litigation. The 2007-2008 high profile BSKYB v EDS trial is a recent example. The Salvage Association v CAP Services, in which members of Chambers were involved, was one of the first breach of warranty cases in the IT industry.
A small number of members of Chambers undertake libel and defamation cases.
Recent cases of note include;
- BSKYB v EDS (TCC)
- Bookmaker Afternoon Greyhound Services v Amalgamated Racing Ltd (Chancery Division)
- Digicel v West Indian Cricket Board (Stanford Twenty/20 Cricket dispute)
