Energy Regulation

The energy sector has consistently generated complex competition and regulatory issues for which Brick Court Chambers has an ideal combination of expertise. The deregulation and liberalisation of energy markets, and the creation of regulatory frameworks to govern those markets, have given rise to an increasing amount of advisory and litigation work. Incumbent producers and carriers are often subject to market investigations. Disputes arise in relation to matters such as energy pricing, interconnection, distribution, joint ventures and State Aid. Members of Chambers are involved during the investigative process as well as representing clients before regulators, the Competition Appeals Tribunal, the European Commission and the European Court of Justice.

Recent cases of note include:

  • Endesa v Commission (CFI)
  • H J Banks v Commission (CFI)
  • National Grid v The Gas and Electricity Markets Authority (CAT)
  • Eon v The Gas and Electricity Markets Authority (Commercial Court)
