Brick Court Chambers practitioners are amongst a very small number of barristers who advise and appear regularly in this highly-specialised field. Product authorisation disputes arise before the European Commission as well as national regulatory bodies such as NICE and the Licensing Authority. The regulation of product evaluation and testing throws up regular disputes, as do patent expiration, pricing and licensing issues. Members of Chambers act for both innovators and generic manufacturers in these disputes. Practitioners have also acted for pharmaceutical companies in product liability cases.
Recent cases of note include:
- Menarini v Commission (CFI)
- Teva Pharmacetical Industries v MHRA (Administrative Court)
- Glaxo v Dowelhurst (ECJ and Court of Appeal)
- O'Byrne v Aventis Pasteur (House of Lords, ECJ)
