Telecommunications
EU and Competition Law have exerted a major impact upon the conduct and regulation of telecoms companies for a long time. Members of Chambers have represented telecoms operators and regulators (such as OFCOM and the European Commission) in a variety of disputes.
In recent years, we have been involved in Telecommunications issues as wide-ranging as mobile call termination charges, the European Commission's attempt to reduce roaming charges between Member States, disputes over number porting and various regulators' investigations into significant market power. Members of Chambers have also acted for holders of patents in cases concerning expiration of rights and in disputes relating to ETSI and cross-licensing.
Beyond these shores, Brick Court Chambers has had recent and regular involvement in competition and regulatory cases in the field of Telecommunications before the courts and regulators of Hong Kong, Gibraltar, Mauritius and Grand Cayman.
Recent cases of note include:
- Hutchinson 3G v Orange, O2, T Mobile and Vodafone (Commercial Court)
- R (Telefonica O2 Europe plc and Others) v S/S Business, Enterprise and Regulatory Reform (European Roaming Charges) (Administrative Court, ECJ)
- Floe Telecom v OFCOM (CAT)
- O2 Germany v Commission (CFI)
