The lawsuits come amid anticipation that the U.K. Supreme Court will rule on an appeal filed by Visa and Mastercard, which lost a similar swipe fees suit against a group of British retailers over the card charges. In that case, the Court of Appeal sided with companies including Argos, Asda Stores Ltd. and Morrisons and Sainsbury's and ruled that the interchange fees breached European Union antitrust rules . That decision came after the High Court and the Competition Appeal Tribunal were split on the issue. Visa is represented by Dinah Rose QC, Brian Kennelly QC, Jason Pobjoy and Isabel Buchanan of Blackstone Chambers, and Daniel Piccinin of Brick Court Chambers, instructed by Milbank Tweed Hadley & McCloy LLP and Linklaters LLP . MasterCard is represented by Mark Hoskins QC and Hugo Leith of Brick Court Chambers, and Matthew Cook of One Essex Court, instructed by Jones Day.
