Jasbir Dhillon
Since graduating from Oxford with a first class law degree and Harvard Law School with a masters degree, Jasbir has been an advocate specialising in complex commercial disputes. Jasbir began his career at the New York Bar with Cravath, Swaine & Moore. Since 1997 he has been a tenant of Brick Court Chambers. Jasbir is recognised by Chambers & Partners and the Legal 500 as a leading junior barrister in Banking and Finance, Commercial Litigation, Commercial Arbitration, Administrative & Public Law and Aviation, and was nominated for Banking & Finance Junior of the Year at the Chambers Bar Awards 2011.
Jasbir has particular expertise in Banking and Finance disputes. His first case on Wall Street involved defending Salomon Brothers from multi-billion dollar claims based on allegations of manipulation of the US treasury bond market. Since then he has been involved in many leading Banking and Finance cases including Barings, Eurotunnel and the Bank Charges litigation. Jasbir has been instructed in relation to a number of disputes arising out of the recent global financial crisis and the insolvency of Lehman including the following substantial proceedings:
- Enasarco v. Lehman Brothers Finance [2011] EWHC 1822 (dispute as to the meaning of loss in 1992 ISDA Master Agreement within €780 million note transaction)
- Perpetual Trustee Co. v. BNY Corporate Trustee Services and Lehman Brothers [2010] BCLC 237 (dispute as to whether contractual rights of investors in US$2 billion Dante note programme overriden as a result of Lehman Brothers' insolvency)
- Deutsche Bank v. Sebastian Holdings [2010] 2 C.L.C. 300 (jurisdiction challenge in relation to US$700 million FX derivative trading dispute)
- Deutsche Bank AG v. Vik [2010] EWHC 551 (Comm) (jurisdiction challenge with respect to multi-million dollar restitution/constructive trust claim)
- Shinhan v. JP Morgan & Citibank (US$300 million securitised loan notes dispute)
He is an assistant editor of Paget's Law of Banking, widely regarded as the leading practitioner text in Banking.
Jasbir has experience of a wide variety of areas of Commercial Law and other areas of Civil Law including Company, Insolvency, Intellectual Property, Regulatory, Competition, Public & Human Rights, Media, Sports and European Union. This year Jasbir has appeared in two recent Supreme Court cases:
- R. (Electoral Commission) v. City of Wesminster Magistrates' Court [2010] 3 WLR 705 (scope of statutory power to forfeit impermissible political donations)
- R (JS) v. Secretary of State for the Home Department [2010] 2 WLR 766 (scope of complicity doctrine in relation to war crimes and crimes against humanity)
He regularly appears in the High Court (Commercial Court and Chancery Division) and Court of Appeal, as well as international arbitrations and regulatory and disciplinary tribunals. As well as regularly being led by Silks, Jasbir is frequently instructed as sole advocate in trials, substantial applications and appeals.
He is a member of the Standards Committee of the Bar Standards Board. He has been a member of the New York Bar since 1993 and he has been a member of the US Supreme Court Bar since 1998.
