Peter Irvin
Peter Irvin has been in practice at Brick Court Chambers since 1973. He has extensive experience as an advocate, adviser and arbitrator in a wide variety of civil and commercial cases, and has appeared before courts and tribunals at every level. This is reflected in over 100 reported cases.
Has advised and acted, both as leading counsel and senior junior, in a wide variety of commercial cases (including banking, insurance, shipping, international trade, competition and restraint of trade), restitution/ fraud/constructive trust; also in professional disciplinary tribunals, arbitration (particularly maritime arbitration), employment and discrimination and professional negligence. Also has extensive experience in letters of request/deposition proceedings and has represented clients in a number of commercial and professional negligence mediations.
Recent major commercial cases include Comanco-v-TGC Ventures and others (US $200 million oil pipeline dispute); Associated British Ports -v- Ferryways and MSC (£30m claim to enforce guarantee); Tavoulareas -v- Tsavliris (claim in respect of a major salvage operation); Templeton Insurance-v-Motorcare warranties and others (constructive trust etc claim by underwriters against insurance agents); Boulogne Chamber of Commerce-v-Speedferries (maritime lien/jurisdiction); National Ability SA -v- Tinna Oils and Chemicals (appeal on enforcement of arbitration award outside limitation period); ICC arbitration involving a well-known international accountancy practice and disputed right to use of the trading name and logo; LMAA arbitration in dispute between owners and vessel managers; LMAA arbitrator in charter party dispute involving heavy weather damage.
Previously acted for the successful Defendant in a long-running multimillion dollar competition case involving shipping conferences (Arkin-v-Borchard), and in the equally long-running Raja -v- Van Hoogstraten litigation (fraud/abuse of process/sequestration proceedings).
