Stephen Midwinter
Stephen Midwinter has advised on and appeared, led and unled, in a wide range of commercial disputes. In the past 5 years he has been instructed on a number of complex and important cases including Wasa and AGF Insurance -v- Lexington (House of Lords); NTSC -v- Jamaica (Privy Council); Cavell -v- Seaton Insurance (Court of Appeal); Markel -v- Higgins (Court of Appeal); Korean National Insurance v Allianz (Court of Appeal); Equitas -v- Horace Holman (Commercial Court); Yugraneft -v- Abramovich (Commercial Court), Yukos -v- Russian Federation (ECHR) and Perpetual and Belmont -v- Bank of New York (Supreme Court).
He has also appeared in numerous insurance arbitrations in London and Bermuda in every field from PA spiral reinsurance claims to marine and aviation coverage disputes. Stephen is called to the bar of the British Virgin Islands where he has appeared in jurisdiction disputes relating to civil fraud claims including Transworld -v- Bluzwed (BVI) and Sibir Energy -v- Sibneft (BVI).
Current work includes a $40m marine insurance coverage dispute, a $50m construction DSU insurance arbitration and a $100m solicitors' negligence claim as well as many and varied smaller commercial disputes of every kind ranging in value from £100,000 to £20 million. Stephen is also presently engaged in a number of high-profile banking cases including a $500m Russian bank guarantee dispute and FGIC -v- IKB, one of the largest "credit crunch" claims before the Commercial Court in London.
Stephen has written several articles on commercial law subjects, and writes and lectures on commercial conflict of laws topics including the Brussels Regulation and the Rome I and II Regulations.
