Litigating competition law in the English courts
English High Court. It will cover:
- Typical situations in which competition law claims or defences may be available;
- The advantages and disadvantages of litigating in the High Court versus a complaint to the OFT
- A detailed consideration of the different remedies available: avoidance, injunctions and damages. In particular, issues in relation to:
- Set off;
- Severance;
- Mandatory/Prohibitory injunctions;
- Passing on defence in damages;
- Exemplary/punitive damages;
- quantification of damages
- Tactical concerns: including the role of expert witnesses and the importance of the pleadings.
