Litigating competition law in the English courts

English High Court. It will cover:

  • Typical situations in which competition law claims or defences may be available;
  • The advantages and disadvantages of litigating in the High Court versus a complaint to the OFT
  • A detailed consideration of the different remedies available: avoidance, injunctions and damages. In particular, issues in relation to:
    • Set off;
    • Severance;
    • Mandatory/Prohibitory injunctions;
    • Passing on defence in damages;
    • Exemplary/punitive damages;
    • quantification of damages
  • Tactical concerns: including the role of expert witnesses and the importance of the pleadings.
