The modern law of tort in a commercial context
The talk will consider to what extent the common law will impose a duty of care on parties in a commercial context, even though the parties have chosen not to contract with one another and instead have chosen to contract with someone else. In particular, it will focus on the recent decisions of Colman J in BP v Aon; Moore-Bick J and the Court of Appeal in Riyad Bank; and the House of Lords' discussion of the relevant test for duty of care in Barclays Bank v Customs & Excise.
