The Hearing: Sony faces £2bn class action over “unfair” PlayStation download charges

Big sums, big names: For the next nine weeks, an array of distinguished competition barristers have been enlisted in this closely-followed case including Monckton’s Robert Palmer KC and Daniel Beard KC alongside Brick Court’s Charlotte Thomas and Blackstone’s Gayatri Sarathy. 

The funder’s capacity to back a separate class action brought by Which? against Apple was challenged at a certification hearing in November. At that hearing, Brick Court’s Marie Demetriou KC, representing Apple, asked the Competition Appeal Tribunal to consider whether Which? had secured adequate funding to cover all potentialities of the claim. She further urged the tribunal to “take into account any concerns in relation to the chosen funder”.

During the Apple hearing, Demetriou said: “This dire outlook reflects uncertainty over the future involvement of LCM Ltd’s lender and multiple adverse case outcomes, which have led to multimillion-pound investment write-offs and losses.”
