Application on behalf of Tony and Jane Nicklinson lodged with European Court of Human Rights

18/12/14

On Monday 15 December Jane Nicklinson, both in her own right and on behalf of her husband Tony Nicklinson, lodged an application with the European Court of Human Rights. Their case on the compatibility of the current law on assisted dying with Article 8 of the European Convention of Human Rights was heard by the Supreme Court and judgment was given earlier this year. Jane now argues that the United Kingdom has breached her and Tony’s procedural rights under Article 8 by failing to consider their claims in substance and on their merits.
