Compulsory ADR report published

The Civil Justice Council has adopted and published a report on Compulsory ADR. The report’s authors were Lady Justice Asplin, Professor Andrew Higgins, Mr Justice Trowell and Bill Wood QC of Brick Court Chambers. The report disagrees with previous suggestions that mandatory ADR would offend the European Convention on Human Rights, points out several areas in which ADR processes are already compulsory parts of civil procedure and suggests various factors relevant to the possible further expansion of compulsory ADR.
