EU law challenge to Energy Regulator’s gas tariffing decision dismissed by Irish High Court

On 11th December 2013, the High Court of Ireland dismissed an application for judicial review against the Decision of the Commission for Energy Regulation concerning access tariffs to the Irish gas transmission system. Mr Justice Cooke dismissed claims that the tariff Decision breached provisions of the Gas Directive and Gas Regulation, is ultra vires the powers of the regulator, is contrary to Article 102 of the EU Treaty and amounts to the grant of an unlawful State aid.
