The first ever fast-track damages case has been lodged at the CAT. The Claimant is National Compliance and Risk Qualifications Ltd (NCRQ), a company which develops qualifications in health and safety. The Defendant is the Institute of Occupational Safety and Health (IOSH). NCRQ complains that IOSH has abused its dominant position in the market for the accreditation of health and safety qualifications by refusing to accredit NCRQ’s diploma qualification, thereby reserving the downstream market in training leading to qualifications in health and safety to the incumbent monopolist. NCRQ is claiming an interim injunction.
