Judgment handed down in FW Aviation v VietJet Aviation Joint Stock Company

The English High Court (Mr Justice Butcher) has given judgment in respect of an application by FW Aviation (Holdings) 1 Limited (“FWA”) for the appointment of post-judgment receivers by way of equitable execution over assets of VietJet Aviation Joint Stock Company.

The judgment provides that that in principle (and subject to the terms of the order and evidence as to likely costs) it was appropriate to appoint Receivers over non-Vietnamese assets of VietJet Aviation, one of the leading airlines in Vietnam. The appointment of the Receivers was sought in aid of execution of a series of judgments of the Commercial Court, under which VietJet owes FWA a sum in excess of US$250 million. The judgment sets out a clear analysis of the principles applicable to the circumstances in which the Court will appoint Receivers in aid of execution of unsatisfied judgments, including over foreign assets.
