Tim Johnston speaks at BIICL competition law panel concerning cooperation between businesses in relation to environmental mitigation and human rights abuses

On 16 September, Tim Johnston participated in a BIICL competition law panel that brought together academics, practitioners and corporates to discuss the restrictions that competition law imposes on businesses that want to work together to mitigate environmental harm and secure improved human rights outcomes.

The discussion started by focussing on the relevant legal framework and published guidance. Those principles were then applied by participants to a range of different industries and supply chains. There was broad agreement that competition law looms large as a factor that discourages businesses from working together to secure improved environmental and human rights outcomes. The discussion closed by focussing on how advising lawyers and regulators could provide greater clarity in this area, so that businesses have more confidence concerning what they can and cannot do, when working together.
