Negligence, Incompetence, Deviation and Unseaworthiness

18/03/15

This seminar looked at a topic of perennial interest and practical importance, which is the consequences of (the all too common) negligence and error in the management or navigation of a ship. Such actions may under the Hague Rules provide a defence to a carrier, but equally may involve issues of crew competence, unseaworthiness, due diligence, the ISM code, deviation, and failure to proceed with reasonable despatch. The seminar looked at these topics and how they interact, considering the law as applied in real practical situations.
