A round-table discussion during the ABA Antitrust Spring Meeting, led by Sarah Abram KC, about antitrust/competition enforcement and litigation in the UK now and in the future.

We will exchange ideas over brunch about the seismic developments in the field of UK competition litigation over the past year, and what is to come.

For example:

  • Collective proceedings: What is the threshold for certification in the light of the McLaren ruling of the Court of Appeal and the CAT’s judgment in Gormsen v Meta?  How is the CAT now expected to case manage collective claims?
  • Individual damages actions: What does the judgment in Trucks Trial 1 tell us about the approach of English courts in future cases?
  • Regulatory appeals: What are the implications of the CAT’s judgment in BMW v CMA for disclosure requests aimed at foreign businesses?
  • Digital Markets: What effect will regulation – new and old – have?
