On 30 November 2021 the Law Commission of England and Wales announced a review of the Arbitration Act 1996. Its consultation paper is expected in September 2022. The premise of the reform exercise is that the legislation is generally sound, and that any changes made will for the limited purpose of bringing it in line with present practice. While this does appear to be a good starting point, there exist deeper issues relating to jurisdiction and applicable law, which call for reform if London is to maintain its place as a preeminent seat for international arbitration. This conference will explore these issues from an English and comparative law perspective.
